VocArt currently does not require user account registration. All data is stored locally on your device and synced through third-party services (RevenueCat for purchases).
5.2 Device-Based Data
Your settings, preferences, and learning progress are stored on your device. You are responsible for:
- Maintaining the security of your device
- Backing up your device if you wish to preserve data
- Understanding that uninstalling the App may result in data loss (except purchases which can be restored)
6. In-App Purchases and Payments
6.1 Purchase Terms
VocArt offers in-app purchases for premium content and features:
- Purchases are processed through Apple App Store or Google Play Store
- Payment is charged to your iTunes Account or Google Play Account
- Prices are shown in your local currency and include applicable taxes
- Prices may vary by region and are subject to change
6.2 One-Time Purchases
For one-time in-app purchases:
- Payment is charged immediately upon confirmation
- Content is delivered digitally and available immediately after purchase
- Purchases are tied to your App Store or Google Play account
6.3 Purchase Restoration
You can restore previous purchases:
- Free of charge on devices using the same App Store or Google Play account
- Using the "Restore Purchases" feature in the App
- Contact us if you experience issues with purchase restoration
6.4 Refund Policy
Refunds are managed by Apple and Google:
- We do not directly process refunds
- Contact Apple App Store or Google Play Store for refund requests
- Refund eligibility is determined by Apple or Google's policies
- Generally, purchases of digital content are non-refundable except as required by applicable law
7. Intellectual Property Rights

All Content, features, and functionality of VocArt are owned by us or our licensors and are protected by copyright, trademark, patent, and other intellectual property rights. This includes:
- Artwork and illustrations

- Audio recordings and pronunciations

- VocArt name, logo, and branding
7.2 Artist and Illustrator Rights
Artworks featured in VocArt are created by commissioned artists and illustrators:
- We hold appropriate licenses to use and distribute the artwork
- Artist attribution is provided within the App
- You may not use artwork outside of the App without artist permission
7.3 User Feedback
If you provide feedback, suggestions, or ideas:
- You grant us a worldwide, royalty-free license to use such feedback
- We are not obligated to implement your suggestions
- We may use your feedback without compensation or attribution
8. Prohibited Uses and Conduct
8.1 You Agree NOT To:
Misuse the Service
- Use the Service for illegal purposes
- Violate any local, state, national, or international law
- Infringe on intellectual property rights
Attempt Unauthorized Access
- Hack, breach, or circumvent security measures
- Access non-public areas of the App or systems

9.3 Content Availability
We reserve the right to:
- Add, modify, or remove Content at any time
- Update translations and artwork
- Discontinue certain artworks or language combinations
- Make changes without prior notice
10. Third-Party Services and Links

VocArt integrates with third-party services:
- Apple App Store / Google Play Store: For app distribution and purchases
- Firebase (Google): For analytics and content delivery
- RevenueCat: For purchase management

11. Disclaimers and Warranties
11.1 "AS IS" and "AS AVAILABLE"
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, ACCURACY OR COMPLETENESS.
11.2 No Guarantee of Service
We do not guarantee that:
- The Service will be uninterrupted, secure, or error-free
- Defects will be corrected
- The Service is free of viruses or harmful components
- Results from using the Service will be accurate or reliable
11.3 Educational Effectiveness
We make no warranties regarding language learning outcomes, effectiveness of our teaching methods, speed of language acquisition, or proficiency levels achieved.
12. Limitation of Liability
12.1 Exclusion of Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, LOSS OF PROFITS, REVENUE, DATA, OR USE, LOSS OF BUSINESS OPPORTUNITY OR GOODWILL, OR ANY DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE SERVICE.
12.2 Maximum Liability Cap
OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED:
- The amount you paid to us in the 12 months preceding the claim, OR
- $100 USD (whichever is greater)
13. Indemnification
You agree to indemnify, defend, and hold harmless VocArt, its affiliates, officers, directors, employees, agents, and licensors from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use or misuse of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Your violation of applicable laws or regulations
14. Termination
14.1 Termination by You
You may terminate your use of VocArt at any time by:
- Uninstalling the App from all your devices
- Ceasing to access the Website
- No formal notice is required
14.2 Termination by Us
We may terminate or suspend your access immediately, without notice, for:
- Violation of these Terms
- Illegal or unauthorized use
- Business or legal reasons
- Requests by law enforcement
14.3 Effect of Termination
Upon termination:
- Your license to use the Service immediately ends
- You must cease all use of the App and Website
- Locally stored data may be deleted
- Certain provisions of these Terms survive termination (Sections 7, 11, 12, 13, 15)
15. Governing Law and Dispute Resolution
15.1 Governing Law
These Terms are governed by and construed in accordance with the laws of Poland, without regard to conflict of law provisions.
15.2 Informal Resolution
Before filing a formal claim:
- Contact us to attempt informal resolution
- Provide a detailed description of the dispute
- We will attempt to resolve the matter within 30 days
15.3 Class Action Waiver
You agree to resolve disputes on an individual basis only. You waive any right to participate in class actions or bring representative actions.
16. App Store Additional Terms
Apple App Store
If you download the App from the Apple App Store:
- These Terms are between you and VocArt, not Apple
- Apple has no obligation to provide support or maintenance
- Apple is not responsible for the App or its content
- Apple is a third-party beneficiary of these Terms
Google Play Store
If you download the App from Google Play Store:
- These Terms are between you and VocArt, not Google
- Your use is also subject to Google Play Terms of Service
17. Miscellaneous Provisions
17.1 Entire Agreement
These Terms constitute the entire agreement between you and VocArt regarding the Service and supersede all prior agreements and understandings.
17.2 Severability
If any provision of these Terms is found to be unenforceable, that provision will be modified or removed, and all other provisions remain in full force.
17.3 Waiver
Our failure to enforce any right or provision is not a waiver of that right. Waivers must be in writing.
17.4 Assignment
You may not assign or transfer these Terms or your rights. We may assign these Terms without restriction.
17.5 Force Majeure
We are not liable for failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, government actions, internet outages, or pandemics.
17.6 Language
These Terms may be translated into other languages. The English version prevails in case of conflict.
